After the shipment of a part of the equipment, the plant demanded its payment, as it needed money to continue the work on manufacturing the rest of the equipment. The customer refused to fulfill such a requirement, referring to the fact that under the terms of the contract payment must be made after delivery of the entire crane. The plant insisted on payment, indicating that the equipment was delivered ahead of schedule. The parties did not agree. In addition, referring to the fact that the equipment received, due to the unwillingness of the workshop to install it to deteriorate under the open sky, the port sued the court to recover a fine from the factory for early delivery.
