French citizen R. was charged with murder and taken into custody in January 1998. However, in March of the same year he was released and the criminal case against him was terminated.
R. considered that he had been unlawfully publicly accused of committing a crime by the Minister of the Interior through the media, and appealed to the Prime Minister with a request for compensation for material and moral damage. The appeal was unsuccessful. The French courts refused to examine the complaint to the applicant. The applicant appealed to the European Court of Human Rights with a request to find a violation of paragraph 2 of Art. 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
