LLC Primorye transferred Sibiryak CJSC for temporary gratuitous use of an electric saw. A year later, the new general director of the company sold it to the Pribrezhniy production cooperative. Upon learning of this transaction, the LLC director filed a lawsuit against the buyer, the Coastal Production Cooperative, for claiming a saw from someone else’s illegal possession. Objecting to the claim, the defendant stated:
a) he did not know that the seller does not own the saw;
b) the saw is released from the possession of the owner by his will when making a gratuitous transaction;
c) an LLC does not own a saw for more than a year and, therefore, has lost its right to it;
d) the cooperative spent on repair of a saw of 10 000 rubles.
Analyze the objections of the defendant and resolve the dispute.
