The State Property Management Committee leased LLC Lavanda non-residential premises in a separate building for a period of 5 years. A year later, the right to enter into a lease for the entire building for a period of 25 years was sold at a tender to the joint stock company Calvados. The latter, when placed in a building, discovered the fact that there was another tenant in it and demanded Lavanda LLC to pay the rent in an increased amount or to vacate the occupied space. LLC Lavender refused to comply with the requirements of JSC Calvados and appealed to the Arbitration Court with a claim for recognition of the tender for the sale of the right to conclude a lease agreement is invalid.
